Scott Noya’s practice focuses on all aspects of real estate, including eminent domain, inverse condemnation, environmental, land use, title and boundary disputes, broker liability, construction contract and business disputes, premises liability and public entity defense.
With extensive jury trial experience in a wide range of complex legal matters, Noya practices in federal, state and appellate courts in California and Hawaii.
Noya has achieved the highest available rating (A-V) for ethics and legal ability from Martindale-Hubbell, a nationally recognized peer review organization.
During more than two decades of practicing law Noya has represented clients in high-profile redevelopment and other major public and private projects, real estate acquisition, land use and environmental matters. Noya has litigated condemnation matters for public agencies, school districts and cities throughout California.
Noya’s eminent domain expertise includes successfully defending multiple right-to-take challenges to the downtown San Diego Ballpark Redevelopment Project and handling land valuation jury trials for this widely-recognized redevelopment effort that brought Petco Park to San Diego’s East Village.
Noya also represented the City of San Diego at both trial and appellate levels in the prominent California case of City of San Diego v. Sobke, a landmark decision on valuation of loss of business goodwill in eminent domain.
Recent Projects
Downtown San Diego Parks Project (2007-2010)
East Village Green – West Block: Working closely with Centre City Development Corporation (CCDC), acquired entire block of property bounded by 13th, 14th, F and G Streets in downtown for the Redevelopment Agency of the City of San Diego’s Parks Project. Acquisition involved multiple parcels, contamination remediation cost recovery, complex loss of goodwill issues, relocation and reestablishment of businesses.
East Village Green – East Block: Acquisition currently underway of block of property bounded by 14th, 16th, F and G Streets in downtown San Diego’s East Village for future public park development.
St. Joseph’s Park: Acquisition currently underway of entire block of property bounded by Cedar, Beech, 3rd and 4th Avenues in downtown San Diego for future public park development.
Historic Balboa Theatre Project (2007-2008): Assisted CCDC and the Redevelopment Agency of the City of San Diego in the revitalization and reopening of the historic Balboa Theatre by acquiring necessary access easement rights from adjacent apartment complex and shopping center owners.
Simon Levi Building Project (2006-2007): Assisted CCDC and the Redevelopment Agency of the City of San Diego in acquiring emergency access easement rights necessary to preservation of the historic Simon Levi building in downtown.
Pharmaceutical Corporation Headquarters Land Acquisition (2009-2010): Assisted major publicly-traded pharmaceutical corporation in acquiring large parcel of property for development of new headquarters and research facility. Conducted due diligence, land use and environmental review, negotiated purchase agreement and advised on related transaction and lease documents.
Metrolink Station Development – City of Placentia (2008-2009): Conducted eminent domain land acquisition for the Metrolink Station Project in City of Placentia, planned in cooperation with the Orange County Transportation Authority. Property acquired for this commuter rail project required relocation of multiple businesses operating in former orange packing warehouses.
Downtown Parking Project – City of Placentia (2009-2010): Conducted eminent domain land acquisition of multiple parcels for City of Placentia’s Downtown Parking Project serving the historic Santa Fe district and nearby future commuter rail station project.
Los Angeles Non-Profit Land Acquisition and Joint Venture Development (2008 – 2009): Advised major Los Angeles non-profit organization in acquiring multiple adjacent parcels of property for development of office buildings, parking structures and non-profit services facility. Negotiated joint venture development agreement and related transaction and lease documents.
Orange County Religious Facility Development and Restructure of Debt Financing (2009): Assisted major religious organization with development of 190,000 square foot multi-use facility in Orange County. Handled litigation of construction claims, contract and lien disputes. Negotiated $40 million construction loan and restructured permanent debt financing with major national lenders.
San Diego County Religious Facility Development Dispute (2009): Advised major religious organization in multi-million dollar property acquisition and worship center development dispute.
Cost Recovery Action - Stockton Redevelopment Agency (2006-2007): Federal Court granted summary adjudication finding BNSF and Union Pacific railroads liable for diesel fuel contamination of former rail lines. Uncovered 1950’s documents proving the railroads designed pipeline causing contamination – railroads denied knowledge of pipeline until day of motion hearing.
